Conditions générales d'utilisation

Les présentes Conditions Générales d'Utilisation (« CGU ») régissent l'accès et l'usage du service Urgentis par les agents et administrateurs d'un organisme client (commune, mutualité, administration) ayant signé un contrat de service avec Pixel Company.

Pour l'usager, l'usage de la borne ne nécessite aucune acceptation explicite ; la politique de confidentialité s'applique de plein droit.

1. Définitions

• Service : la plateforme Urgentis.
• Éditeur : Pixel Company, Bruxelles, Belgique.
• Représentants légaux de Pixel Company : Ismail Ouaamari et Marwane Moustapha.
• Titulaire des droits (concept, design, code Urgentis) : Rami Oulad Seghir Hajjaj.
• Organisme client : autorité publique ou organisme privé ayant souscrit au service.
• Agent: personne physique habilitée par l'organisme client à accéder à l'espace staff.
• Usager : citoyen, patient ou affilié utilisant la borne sans authentification ou avec un rendez-vous.

2. Accès au service

L'accès à l'espace agent se fait par identifiants nominatifs (email + PIN). Chaque agent s'engage à :

• Ne pas partager ses identifiants ni laisser sa session ouverte sur un poste non surveillé.
• Signaler immédiatement à son administrateur tout accès non autorisé.
• Utiliser le service uniquement dans le cadre de ses missions professionnelles.

3. Engagements de l'éditeur

• Maintenir le service disponible avec un objectif de disponibilité de 99,5 % par mois (hors maintenances planifiées).
• Notifier toute interruption planifiée au moins 48 heures à l'avance.
• Conserver les données dans l'UE et appliquer les mesures de sécurité décrites dans le DPA.
• Notifier toute violation de données dans un délai maximal de 24 heures après détection.

4. Usage interdit

L'agent s'interdit notamment de :

• Tenter de contourner les mesures de sécurité ou les contrôles d'accès.
• Extraire massivement des données par script ou scraping non autorisé.
• Utiliser le service pour traiter des données non liées à la mission de l'organisme.
• Communiquer à des tiers des données usagers sans base légale.

Tout manquement peut entraîner la suspension immédiate du compte et un signalement aux autorités compétentes (APD belge, parquet).

5. Disponibilité et limites

Le service est fourni « en l'état ». L'éditeur ne garantit pas que le service répondra à des besoins spécifiques de l'organisme au-delà de ce qui est décrit dans le contrat de service.

La responsabilité de l'éditeur est limitée aux dommages directs et plafonnée au montant payé par l'organisme au cours des 12 derniers mois, sauf en cas de faute lourde, dol ou violation des obligations essentielles RGPD.

6. Données et confidentialité

Le traitement des données est régi par le DPA conclu entre l'organisme client et l'éditeur, conformément à l'article 28 RGPD.

La politique de confidentialité détaille les traitements pour les usagers.

7. Propriété intellectuelle

Le concept, le design, le code source et l'ensemble des éléments du service Urgentis sont la propriété exclusive de Pixel Company, représentée par son fondateur et titulaire des droits, Rami Oulad Seghir Hajjaj.

La signature du contrat de service confère à l'organisme client une licence d'usage limitée et non transférable, sans aucune cession de droits patrimoniaux.

8. Modifications des CGU

L'éditeur peut modifier les CGU. Les modifications substantielles sont notifiées à l'administrateur de l'organisme au moins 30 jours avant leur entrée en vigueur.

La poursuite de l'utilisation après cette date vaut acceptation.

9. Résiliation

Chaque partie peut résilier le contrat de service avec un préavis de 90 jours.

À l'échéance, l'éditeur restitue les données de l'organisme au format structuré (CSV/JSON) puis procède à leur suppression irréversible dans un délai de 30 jours, en délivrant un certificat de destruction.

10. Droit applicable

Les présentes CGU sont régies par le droit belge. Les tribunaux de l'arrondissement judiciaire de Bruxelles sont seuls compétents.

Terms of Use

These Terms of Use ("Terms") govern access to and use of the Urgentis service by agents and administrators of a client organisation (municipality, mutual insurance fund, public administration) who has signed a service agreement with Pixel Company.

For end users, use of the kiosk requires no explicit acceptance; the privacy policy applies by operation of law.

1. Definitions

• Service: the Urgentis platform.
• Publisher: Pixel Company, Brussels, Belgium.
• Legal representatives of Pixel Company: Ismail Ouaamari and Marwane Moustapha.
• Rights holder (Urgentis concept, design, code): Rami Oulad Seghir Hajjaj.
• Client organisation: public authority or private entity that has subscribed to the service.
• Agent: natural person authorised by the client organisation to access the staff area.
• User: citizen, patient or member using the kiosk without authentication or with an appointment.

2. Access to the service

Access to the agent area is granted via individual credentials (email + PIN). Each agent undertakes to:

• Not share their credentials or leave their session open on an unattended device.
• Immediately report any unauthorised access to their administrator.
• Use the service solely within the scope of their professional duties.

3. Publisher commitments

• Maintain service availability with a target of 99.5% per month (excluding scheduled maintenance).
• Notify any planned interruption at least 48 hours in advance.
• Store data within the EU and apply the security measures described in the DPA.
• Notify any data breach within a maximum of 24 hours after detection.

4. Prohibited use

The agent specifically undertakes not to:

• Attempt to bypass security measures or access controls.
• Carry out mass data extraction by script or unauthorised scraping.
• Use the service to process data unrelated to the organisation's mission.
• Disclose user data to third parties without a legal basis.

5. Availability and limitations

The service is provided "as is". The publisher does not warrant that the service will meet specific needs of the organisation beyond what is described in the service agreement.

The publisher's liability is limited to direct damages and capped at the amount paid by the organisation over the previous 12 months, except in cases of gross negligence, wilful misconduct or breach of essential GDPR obligations.

6. Data and confidentiality

Data processing is governed by the DPA concluded between the client organisation and the publisher, in accordance with Article 28 of the GDPR.

The privacy policy details the processing operations for end users.

7. Intellectual property

The concept, design, source code and all elements of the Urgentis service are the exclusive property of Pixel Company, represented by its founder and rights holder, Rami Oulad Seghir Hajjaj.

Signing the service agreement grants the client organisation a limited, non-transferable licence of use, with no transfer of economic rights.

8. Amendments to the Terms

The publisher may amend the Terms. Substantial changes are notified to the organisation's administrator at least 30 days before entry into force. Continued use after that date constitutes acceptance.

9. Termination

Either party may terminate the service agreement with 90 days' notice. Upon termination, the publisher returns the organisation's data in a structured format (CSV/JSON) and then proceeds to its irreversible deletion within 30 days, issuing a destruction certificate.

10. Applicable law

These Terms are governed by Belgian law. The courts of the judicial district of Brussels have exclusive jurisdiction.

Algemene gebruiksvoorwaarden

Deze Algemene Gebruiksvoorwaarden (« AGV ») regelen de toegang tot en het gebruik van Urgentis door de agenten en beheerders van een klantorganisatie (gemeente, mutualiteit, administratie) die een dienstcontract met Pixel Company heeft ondertekend.

Voor de gebruiker vereist het gebruik van de zuil geen uitdrukkelijke aanvaarding ; het privacybeleid is van toepassing.

• Dienst : het Urgentis-platform.
• Uitgever : Pixel Company, Brussel, België.
• Wettelijke vertegenwoordigers van Pixel Company : Ismail Ouaamari en Marwane Moustapha.
• Houder van de rechten (concept, design, code Urgentis) : Rami Oulad Seghir Hajjaj.
• Klantorganisatie : openbare overheid of private organisatie die de dienst heeft aangeschaft.
• Agent : door de organisatie bevoegde persoon.
• Gebruiker : burger, patiënt of aangeslotene die de zuil gebruikt.

2. Toegang

• Geen identificatiegegevens delen of sessies onbeheerd open laten.
• Onmiddellijk elke onbevoegde toegang melden.
• De dienst enkel gebruiken voor opdrachten van algemeen belang.

3. Verbintenissen van de uitgever

• Beschikbaarheidsdoel 99,5 % per maand.
• Melding van geplande onderhouden minstens 48u op voorhand.
• Gegevensopslag in EU + beveiligingsmaatregelen DPA.
• Notificatie van datalekken binnen 24u.

4. Verboden gebruik

• Beveiligingsmaatregelen omzeilen.
• Massale data-extractie of scraping.
• Gebruik buiten de organisatieopdracht.
• Doorgifte aan derden zonder rechtsgrond.

5. Beschikbaarheid en aansprakelijkheid

De dienst wordt « as is » geleverd. De aansprakelijkheid is beperkt tot directe schade, geplafonneerd op het bedrag betaald in de 12 voorgaande maanden, behalve bij grove fout of opzet of schending van essentiële AVG-verplichtingen.

6. Gegevens en vertrouwelijkheid

De gegevensverwerking wordt geregeld door de DPA, conform artikel 28 AVG.

7. Intellectuele eigendom

Het concept, het ontwerp, de broncode en alle elementen van de Urgentis-dienst zijn de exclusieve eigendom van Pixel Company, vertegenwoordigd door haar oprichter en houder van de rechten, Rami Oulad Seghir Hajjaj.

8. Wijzigingen

Wijzigingen worden minstens 30 dagen op voorhand meegedeeld aan de beheerder van de klantorganisatie.

9. Beëindiging

Elke partij kan met 90 dagen opzegtermijn beëindigen. Bij beëindiging worden de gegevens overgedragen in CSV/JSON-formaat en daarna onomkeerbaar verwijderd binnen 30 dagen.

10. Toepasselijk recht

Deze AGV worden beheerst door Belgisch recht. De rechtbanken van het gerechtelijk arrondissement Brussel zijn uitsluitend bevoegd.
